Reasons You May Need to Seek Out a Divorce Lawyer If You're Considering Divorce

Divorce is one of the most stressful things that can happen to a person. It's an emotional, financial, and social upheaval with long-lasting effects on all parties involved. Whether you're considering divorce or are in the process of getting divorced, you should speak with an attorney.

Here are a few reasons you should seek the services of a divorce lawyer.

1. Custody Issues

You will need to go through a difficult custody battle if you and your spouse cannot agree on who gets custody of your children. When you work with a divorce lawyer, they can help mediate between parents and ensure that everyone's rights are protected without the need for a drawn-out fight.

2. Property Division

Most states require you to divide property fairly during your divorce, but this can be challenging without an attorney. Your spouse's lawyer will have the manpower necessary to exhaustively search for assets and research all of your claims before negotiations begin, so it is important that you have someone on your side.

3. Spousal and Child Support

If you and your spouse cannot agree on who receives spousal and child support, it will be up to a judge to make that decision for you. Before the court date, your lawyer can help you calculate fair numbers based on current earnings as well as future earning potential for both partners.

4. Any False Claims

You can reduce the chances of your spouse making false claims about you and your life together if you have a lawyer present during all proceedings. If they do make any false claims, your divorce lawyer can help you prove that those statements are not true and help you win custody or other issues related to those lies.

5. Any Abuse

If your spouse is physically or emotionally abusing you or your children, do not wait to seek out legal help. Your divorce lawyer can file for emergency protective orders and immediately get you the safe haven you deserve during these troubling times.

6. Any Fraud

If your spouse has committed fraud in the marriage, you need an attorney on your side during this process. Your divorce lawyer can help you recover funds and understand what steps to take to protect yourself financially in the future.

The most common reasons for divorce in the United States are incompatibility at 43%, adultery at 28%, and money concerns at 22%. Regardless of the reason, you should seek legal counsel as soon as possible if you're considering divorce. A good attorney can help protect your rights and make sure that your spouse can't take advantage of you or make false claims during these trying times. Here’s why: In standard possession orders, the father is entitled to possession of the child on Father’s Day weekend. This year, Father’s Day weekend is the second Friday of June. That means fathers with standard possession orders will get four (4) weekends in a row. To break up this time, mothers will have to make a timely – and specific – designation. Have you made your summer possession designations? Remember, all non-custodial parents, get to designate periods of extended summer possession for your children. The deadline is April 1st. If you don't, your default summer possession will be July 1st thru July 31st (if your order contains a Standard Possession Order). For the custodial parent, you have certain times set out for you for summer possession, as well. If you give the non-custodial parent notice by April 15th you can designate one weekend inside their thirty-day period of extended summer possession to have the children. If you do not designate this weekend by April 15 th , then you lose that weekend. Contact me so that I can help you navigate these difficult issues.

If you are subject to a standard possession order, the next few weeks are very important for you. Here’s why: In standard possession orders, Spring Break is divided out as even and odd years. So, if you are the primary parent, you typically have even Spring Break possession. Because Spring Break falls in an even year this year, the primary parent would have possession of the child beginning at 6:00 p.m. on the day school ends and continuing until 6:00 p.m. on the day before school resumes from the break. Do you know your holiday schedules or need them modified? Contact me so that I can help you navigate these difficult issues.
